It shall be the policy
of the Bay de Noc Community College Board of Trustees to recognize the agency which has
the bargaining rights for a group of employees and negotiate with their designated
representative.
When no bargaining
agency exists, conditions of employment and wages shall be reviewed annually by the Board
of Trustees.
103.1Getting the job done is the most important condition of employment. Schedules and
vacations are subordinate to it.
103.2The administrator is the best person to
determine what hours he/she should work.It
is expected that an administrator will put in a minimum of forty (40) hours a week and
that a schedule for time on the campus will be developed and generally followed.
103.3The administrator is
the best person to determine when to take his/her vacation.
103.4Although compensatory time is not allowed for administrators who report to the
President, they are encouraged to make sure they have adequate time for themselves and
their families.
103.5Administrators who teach classes for the college must have prior approval of their
immediate supervisor.Up to the prevailing
part-time rate may be paid.
103.6Administrators should always let their
secretary, a co-worker or the switchboard know where they can be reached if they are away
from the campus during what they specify as normal working hours.
It shall be the policy
of the Bay de Noc Community College Board of Trustees to assure the provisions of equal
opportunity and equal access in educational acts.These
provisions apply in all areas of employment, student services, and instructional programs.Discrimination because of any legally protected
status, which includes but is not limited to, race, color, religion, creed, gender,

Grievance
Procedures
If
any person believes that Bay de Noc Community College or any part of the college is in
some way discriminatory on the basis of any legally protected status, which includes but
is not limited to, race, color, religion, creed, gender, national origin, political
affiliation, age, height, weight, disability, marital or veteran status, he/she may
forward a complaint to an EEO coordinator, either the Executive Director of Development,
Marketing, & Government Relations or the Director of Human Resources, Bay de Noc
Community College, Escanaba, MI 49829-2511.
104.1Informal Procedure:
a. The person who
believes he/she has a valid basis for complaint shall discuss the concern with the
appropriate coordinator, who shall in turn investigate the complaint and reply to the
complainant in writing within five (5) business days or as soon thereafter as possible.If this reply is not acceptable to the
complainant, he/she may initiate formal procedures according to the steps listed.
104.2Formal Procedure:
a.
A written statement of the grievance shall be prepared by the complainant and signed.This grievance shall be presented to the
appropriate coordinator within five (5) business days of receipt of the written reply to
the informal complaint.The coordinator shall
further investigate the matters of the grievance and reply in writing to the complainant
within five (5) business days by certified mail or as soon thereafter as possible.
b.
If the complainant wishes to appeal the decision of the coordinator, he/she may submit a
signed statement of appeal to the president within five (5) business days after receipt of
the coordinators response to the grievance.The
president shall meet with all parties involved, formulate a conclusion, and respond in
writing to the grievance within ten (10) business days by certified mail or as soon
thereafter as possible.
c.
If the complainant remains unsatisfied, he/she may appeal through a signed, written
statement to the Board of Trustees within five (5) business days of his/her receipt of the
Presidents response in b.
In
an attempt to resolve the grievance, the Board of Trustees or a committee thereof, shall
meet with the concerned parties and their representatives within fifteen (15) business
days of the receipt of such an appeal.A
copy of the Boards disposition of the appeal shall be sent by the Board secretary to
each concerned party within ten (10) business days of this meeting by certified mail or as
soon thereafter as possible.
d.
If, at this point, the grievance has not been satisfactorily settled, further appeal may
be made to the Office of Civil Rights, 303 W. Kalamazoo, Lansing, MI 48913.
